This is a thread concerning the draft of the new constitution.
This thread is to discuss the new constitution. I too the time to spote loopholes and correcting them, and editing some aged details.
You can posts your comments, additions, critique, etc.. in the comments below.
by no mean should this post be edited by anyone except the authors of it (to prevent any unwanted editing or manipulation of the version)
I. Fundamental Principles
Art. 1
1) Slavia is a region which recognizes all the sovereign states within it.
2) The Constitution shall be the supreme law, and no other law shall contravene it.
3) Nations who proceed to violate the law stated by the constitution or passed by the Slavian parliament will dace appropriate action against them.
Art. 2
1) The official languages of Slavia are English and all the Slavic languages.
2) All nations are welcome in Slavia, regardless of their heritage or background. (With the exception of those nations whose names, flags, or principles are offensive, minutely or strongly.)
Art. 3
1) The Region of Slavia shall be governed by executive order from the founder, the executive branch and Parliament. The rule of law will shall influence the decisions made by the government in a profound way.
2) The region of Slavia shall respect and guarantee the right to exist, to self-defence, to express opinion, to a fair trial of the individual, and shall create conditions conducive to the free development of the individual and of civil society.
II. Fundamental Rights and Duties of the Citizens
Art. 4
1) All nations residing in Slavia shall be considered residents, not citizens.
2) Citizenship shall be granted to residents seeking it and fully adhering to the laws all the people living within the nations of the Region of Slavia.
3) All citizens are born free and equal in dignity and rights. All citizens shall be equal before the law. There shall be no privileges or restriction of rights on the grounds of race, gender, national or social origin, religion, education, personal or social status or property status, or finally previous game history.
Art. 5
1) Nations that mindlessly condemn the rule of the government and/or the executive order without sensible rationality can be classified as offenders, and charged with Low-Level Treason.
2) There will be freedom of speech, with the following exceptions: Obscene content, threatening content, content that insults the people of Slavia, content that insults the administration of Slavia, content that insults any Slavic group, and spam.
3) Any act of treason, whether it be Low-level, Mid-Level, or High-Level, may result in the offender being banned and/or ejected from Slavia, or even losing parliamentary seats, depending on the situation.
III. Regional Government Structure
Art. 6
1) All elections, regional and local referendums shall be held on the basis of universal, equal and direct suffrage.
2) The power of the region shall be divided between the Slavian Parliament and executive branches.
Art. 7
1) The Parliament are formed through popular vote, and appointment by the elected delegate.
Art. 8
1) The Founder and WAD of the Region has the power to take control of all the branches in case of a regional status of emergency.
Art. 9
1) Any nation, that is a registered as citizen, can become World Assembly Delegate, by receiving the greatest number of votes in a WAD election.
2) The World Assembly delegate can ban any nations, with a valid reason.
3) Members of the executive council will follow the same term limit as those followed by the delegate. This is to ensure regional stability.
IV.Parliament
Art. 10
1) The Parliament shall be vested with the legislative authority and shall exercise a form of parliamentary control.
2) The Parliament shall consist of parties supporting different political views.
Art. 11
1) All members of all the Parliament have to obey the law, and have no diplomatic immunity.
2) Parliament members can produce, schedule, and vote on different legislations.
Art. 12
1) Should a Parliament member act irrationally or with severe rudeness towards the people, the regional government, or the administration of Slavia, the council member may be removed by the founder and/or the WA delegate.
2) Parliamentary sessions are to be held for the length of a quarter of a year each. (4 sessions, 3 months each)
3) In each session, members of the parliament can propose, debate & vote on different legislations
V. Executive Council
Art. 13
1) The Executive council can advise the legislations passed by the Parliament, but cannot effect it's outcome.
Art. 14
1) In case of Emergency, The delegate (with his E/C) along with the founder can take control over all the branches.
2) Any law or actions passed under the emergency status, which is usually not in the powers of the council, will be considered invalid once the emergency status has ended.
Art. 15
1) The Executive Council shall conduct regional domestic and foreign policy in accordance to the Constitution and the laws.
VII. Self-Government Administration
Art. 16
1) All the nations within the Region shall have self-government, and constitutions. However, all of the activities and actions made by the nations within Slavia must be with accordance to this constitution. If this is not obeyed those nations will be punished accordingly, and depending on the situation, banned.
Art. 17
1) The Region of Slavia will be divided into nations which have their own customs, religions and culture that are protected and cherished.
2) All the nations within Slavia are independent, however all work for the benefit of the people and the Region
VIII. Slavian Intelligence Service.
Art. 18
1) The Slavian Intelligence Service is not subject to accordance with any single person of group of people.
2) The Slavian Intelligence Service is controlled and maintained by the Founder, the WA Delegate, and possibly members from the executive council.
3) The Slavian Intelligence Service works to ensure the security of the nations within Slavia, and enforces the law upon all nations.
4) The Slavian Intelligence Service is not obligate under any means to share its activity or intelligence with any nation outside of the agency.
5) The Slavian Intelligence Service must respect Slavian citizen’s right to privacy.
IX. Invasions and Military Affairs (this needs to be reviewed in more detail*)
Art. 19
1) Invasions shall be conducted in accordance to the following steps: Proposal, Research, Approval, Preparation, and Execution
2) An Invasion must be approved by the Founder, Minister of Defence, and WA Delegate.
3) Any nation in Slavia may propose an invasion.
4) All WA nations are free to participate in invasions, with the individual consent of the founder.
5) Once successfully invaded by Slavia, a region is subject to re-founding and colonization if contains a population of 10 active members or less.
X. Treason
Art. 20
1) Treason is considered a heavy-crime, and any nation who commits treason will be punished.
2) Treason is divided into three classifications: Low-Level Treason, Mid-Level Treason, and High-Level Treason.
Art. 21
1) Low-Level Treason is punishable by formal condemnation by the founder, WA Delegate, and President, and/or by loss of any government positions or rankings that the offender is associated with.
2) Mid-Level Treason is punishable by loss of any government positions or rankings that the offender is associated with, and/or ejection.
3) High-Level Treason is punishable by ejection and/or banning.
XI. Regional Symbols
Art. 22
1) the official symbols of Slavia are lawfully subject to change and altercation with the approval of the founder.
Art. 23
1) The official symbols of Slavia may not be insulted by any single nation or group of nations.
2) Insulting the official symbols of Slavia is classified as Low-Level Treason, punishable by ejection or banning, depending on the situation.
XII. Political Parties of Slavia
Art. 24
1) Political parties may be formed with the approval of the Founder and WA Delegate.
Art. 25
1) Political Parties may be proposed by any member of Slavia.
2) The disbanding of a political party may be proposed by any member of the regional government.
Art. 26
1) A majority may be declared by the party the majority of the members in the Slavian parliament.
2) Each party shall not have any more rights than the other political parties.
3) Each Party shall not receive any benefits or advantages over the other political parties.
XIII. How to Amend the Constitution
Art. 27
1) The initiative to introduce a constitutional amendment bill shall belong to anyone citizen.
2) An amendment bill can be debated by, and passed by Parliament the elected delegate.
3) Any imitations or falsifications of the constitution will be recognized as false, and the nation who imitates or falsifies the constitution will be condemned, and depending on the severity of the falsification, banned or ejected from Slavia.
XIII. World Assembly Delegate
Art.28
1) The Delegate is elected in a suffrage for a period of 60 days.
2) Only Citizens can vote for any new delegate.
3) Any nation assuming the delegacy, which was not elected in the elections can be removed by the founder.
4) The powers of the delegate are regulated by the appropriate law.
Art.29
1)In case of a resignation (or a disability of the delegate to achieve his/her duties), new elections should be made in a period not exceeding 2 weeks.
2)The delegate shall appoint a caretaker delegate to replace him/her* for the period following the resignation and until a new delegate is elected
* In case that the delegate don't appoint a caretaker delegate, his powers shall be removed by the founder until a new delegate is elected.
3) The Caretaker delegate's powers are limited: His mission is to oversee the new elections* and oversee order until a new delegate is elected**
* In which he cannot be part of
** he may not accept embassy requests, make treaties, form a government, veto laws, ...
4) If the caretaker delegate exceeds his temporary powers, he/she will be punished in accordance with the appropriate law.
